These Terms of Service (“Terms”) are a binding agreement between you and Labely (“Labely”, “we”, “us”) and govern your access to and use of the Labely mobile app for iOS (distributed via the Apple App Store), the Labely mobile app for Android (distributed via Google Play), the website at labelyai.com, and any related features (together, the “Services”). Labely is operated from Romania. By downloading, installing or using the Services on any platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under the age of legal majority where you live, you must have the consent and supervision of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
2. Your account
Some features (for example syncing scan history across devices, or paid features) require an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us at support@labelyai.com promptly if you suspect unauthorized use.
3. Acceptable use
You agree not to:
- Use the Services to violate any law or regulation.
- Reverse engineer, decompile, disassemble or attempt to extract the source code of the Services, except to the extent permitted by mandatory local law.
- Interfere with, disrupt, overload or attempt to gain unauthorized access to the Services, our infrastructure or other users’ accounts.
- Use scrapers, bots or automated tools to access the Services in a way that exceeds normal personal use.
- Submit content that is illegal, infringing, defamatory, hateful, sexually explicit, or that contains malware.
- Resell, sublicense or commercially redistribute the Services or any data we provide, without our written consent.
4. Informational use only — not medical advice
Labely provides plain-language ingredient explanations, nutrition context and an informational score for packaged food and drink products. The Services are intended for general educational and informational use only.
- Labely is not a medical device and is not certified as such.
- The Services do not provide medical advice, diagnosis, treatment, prescription or any other professional health advice, and they are not a substitute for it.
- Labely makes no guarantee of any specific health, weight, nutrition or wellness outcome.
- Always consult a qualified healthcare professional for medical decisions, especially if you have allergies, food intolerances, a chronic condition, are pregnant or breastfeeding, are caring for a child, or are taking medication.
- In a medical emergency, contact your local emergency services. Do not use the Services to manage a medical emergency.
5. Allergy and ingredient verification — your responsibility
Product databases, retailer feeds and AI-generated content can be incomplete, out of date or wrong. Manufacturers may also change formulations without notice. Always read the ingredient and allergen information printed on the physical packaging before consuming a product, especially if you have an allergy, intolerance or specific dietary need. You are responsible for the food choices you make and for verifying the information you rely on.
6. AI-generated content
Labely uses Google AI / Gemini to summarize, translate or explain ingredient and nutrition information. AI-generated content can be inaccurate, incomplete or misleading. We work to keep it accurate, but you should treat AI output as informational only and verify anything important against the physical packaging or another trusted source.
7. Subscriptions, free trial and pricing
Access to the Services is provided through a paid subscription with a 3-day free trial. The following applies.
a. Pricing
- 3-day free trial. New subscribers may start with a 3-day free trial. If you do not cancel before the trial ends, your subscription begins automatically and the first payment is charged.
- Monthly plan: US $3.99 per month.
- Yearly plan: US $29.99 per year, which saves about 37% compared with paying monthly for a year.
- Prices are shown at the point of purchase in your local currency where supported, and may be adjusted by the store for local taxes and conversion. The price displayed on the paywall before you confirm is the price that applies to you.
- You can cancel anytime. Cancelling stops the next renewal — you keep access to paid features until the end of the current billing period (or until the trial ends if you cancel during the trial).
b. Where you buy and how payment is handled
- Subscriptions on iOS are sold and processed by the Apple App Storeunder your Apple ID and Apple’s terms.
- Subscriptions on Android are sold and processed by Google Playunder your Google account and Google’s terms.
- Labely does not collect or store your payment card or bank details. All payment is handled by the App Store or Google Play.
- We use RevenueCat to manage subscription entitlements (so we can unlock paid features and let you restore purchases across devices).
c. Auto-renewal
- Subscriptions auto-renew unless cancelled. Each subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
- Renewals are charged to the payment method on file with the relevant store within 24 hours before the next period begins, at the then-current price for that plan.
- If the price of an auto-renewing subscription changes, the store will ask you to confirm the new price before charging you.
d. How to cancel
- iOS: Settings → your name → Subscriptions → Labely → Cancel subscription.
- Android: Google Play app → menu → Subscriptions → Labely → Cancel subscription.
- Cancelling stops the next renewal. You keep access to paid features until the end of the current period.
e. Refunds
Refunds are handled by the store you bought from (Apple App Store or Google Play) and are subject to that store’s refund policy. Where required by law (for example the EU/UK statutory withdrawal right), additional consumer rights apply and are not affected by these Terms.
f. Restoring purchases
If you reinstall the app or change device, use the Restore purchases option in the app while signed in to the same Apple ID or Google account used for the original purchase.
8. Intellectual property
The Services, including the Labely app, the website, our software, designs, logos and content, are owned by Labely or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the store you downloaded the app from.
9. User content and feedback
If you submit content to the Services (for example, support messages, bug reports, feature requests, or product corrections), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, adapt and display that content to operate, improve and promote the Services. You represent that you have the rights to share whatever you submit. We may use general feedback or suggestions without obligation or compensation.
10. Third-party services
The Services rely on third parties — including Apple App Store, Google Play, Supabase (backend, database, authentication and storage), Google AI / Gemini (AI ingredient analysis) and RevenueCat (subscription entitlements) — and may link to or display content from third parties. Their terms and privacy policies govern your use of their services. We are not responsible for third-party content or services.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, THAT INGREDIENT OR NUTRITION DATA WILL BE COMPLETE OR ACCURATE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LABELY AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA OR HEALTH OUTCOMES, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $50.
Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud, gross negligence, death or personal injury caused by our negligence, or your statutory consumer rights.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold Labely harmless from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
You can stop using the Services at any time by uninstalling the app. You can delete your account from inside the app or by emailing support@labelyai.com (see the Privacy Policy for details). We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if we need to do so to protect the Services, our users or third parties. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability and dispute resolution) will survive.
15. Apple-specific terms (iOS app)
The following applies if you obtained the Labely app from the Apple App Store. You acknowledge that these Terms are between you and Labely only, and not with Apple Inc. (“Apple”). Apple is not responsible for the Labely app or its content. Your use of the Labely app must comply with the Apple Media Services Terms.
- Apple has no obligation to provide any maintenance or support for the Labely app.
- In the event of any failure of the Labely app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Labely app.
- Labely (not Apple) is responsible for addressing any claims by you or any third party relating to the Labely app, including product liability, consumer-protection or intellectual-property claims.
- You represent that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as they relate to your license of the Labely app.
16. Google Play-specific terms (Android app)
The following applies if you obtained the Labely app from Google Play. You acknowledge that these Terms are between you and Labely only, and not with Google. Your use of the app must also comply with the Google Play Terms of Service. Google is not responsible for the app or its content, and to the maximum extent permitted by law, has no warranty or support obligation in respect of the Labely app.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice in the app, by email, or on the website before they take effect. Continued use of the Services after changes take effect means you accept the updated Terms. If you do not accept them, stop using the Services and delete your account.
18. Governing law and disputes
Labely is operated from Romania. These Terms are governed by the laws of Romania, without regard to its conflict-of-law principles. Disputes arising from or relating to these Terms or the Services will be resolved by the competent courts of Romania, except where mandatory local consumer law gives you the right to bring a claim where you live or have it heard there. Nothing in these Terms affects your statutory consumer rights that cannot be waived by contract, including, where applicable, the right to use online dispute-resolution platforms made available by the European Commission.
19. Severability and entire agreement
If any part of these Terms is held to be unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and any in-app or store-level terms that apply to a specific feature or purchase, are the entire agreement between you and Labely regarding the Services.
